How to Deal With WCB Appeals
The First Interview
If you at any point in time have any questions or discrepancies regarding your worker’s injury claim, the first thing that you need to do is to get in contact with the person in charge of your case in order to discuss the matter with them. They will be able to give you the answers that you need, and possibly some advice as to how you should move forward. Should you have additional information, you need to inform the person that is in charge of your case. During the claims process, you may also contact the supervisor for additional information.
When it comes to the appeals department, it will be necessary for you to contact the employer services if your appeal has anything to do with premium assessments, employer experience ratings, industry classification, employer registration processes, or payroll reporting.
If you have gone through the first step and you do not agree with the decision that has been made on your claim, you can put in an appeal with the department of appeals, which happens to be an independent entity. The purpose of the appeals process is to enable the employers to get a clear and independent review of the details of the claim.
When you are in disagreement with the decision made by the people involved with your WCB Appeals, you should contact the appeals department for further assistance.
How to Appeal the Decision
If you need to appeal the decision, you need to fill out the online form that all employers need to complete. You will need to include the name of the worker, the WCB claim number that is related to a specific claim, the details of the claim that is in question (including the person in charge and the date of the claim), your views on how the problem should be solved, and any other information that you think may be relevant.
Here are the steps that you need to follow once you have submitted an appeal to the department of appeals for processing.
When the time comes that you have completed the second step of the process and you still disagree with the final say that the appeals department has voiced, you may then get in touch with the Board Appeal Tribunal.
Should you not be happy with the results after this, you should contact the WCB.
